Before we dive into the fun stuff, we’ve got to tackle the legal bits. I know, not the most exciting part, but hey, it’s necessary! Let's get through this together so we can get to the good times!

Estimate, Authorization, Payment & Storage Policy
Harkins Equipment LLC

1. Purpose
This policy outlines the terms governing estimate services, repair authorization, deposits, payments, storage fees, and abandonment procedures for equipment left in the possession of Harkins Equipment LLC. These terms apply to all customers requesting diagnostic or estimate services.
 
2. Estimate Services & Equipment Condition
All diagnostic and estimate services performed by Harkins Equipment LLC are billable, regardless of whether the customer proceeds with repairs.
Equipment submitted for evaluation may require partial disassembly to complete an accurate diagnosis. If the customer declines repairs, the equipment will be returned as‑is, which may include a partially disassembled state.
Estimate fees and any applicable pickup/delivery charges must be paid prior to the return of equipment when repair estimates are not approved.
 
3. Estimate Acceptance & Authorization Requirements
Estimates must be accepted electronically through the provided QuickBooks link or other approved digital method.
Only the individual with financial and decision‑making authority for the equipment may approve or decline an estimate. Communications from non‑authorized contacts do not constitute approval, decline, or direction.
The date of “customer response” is defined as the date Harkins Equipment LLC receives confirmed communication from the authorized decision‑maker.
 
4. Deposit Requirement
Upon acceptance of an estimate, a deposit equal to 50% of the estimate* total becomes immediately due.
A deposit request will be sent via email through QuickBooks. No work will begin until the deposit is paid in full.

*Final invoice totals may differ from the estimate due to field variables, additional labor, parts availability, or unforeseen conditions discovered during repair.
 
5. Payment Terms
A 3.25% transaction fee will be applied to all electronic payments.
Card payments must be confirmed and processed before equipment is delivered.
Cash or check payments must be made at the time of delivery, on location, and made payable to Harkins Equipment LLC.
If a check is returned or fails to clear, all associated bank fees and administrative charges will be added to the customer’s invoice total.
Any invoice that remains unpaid beyond 90 calendar days may be submitted to small claims court for recovery of the outstanding balance, accumulated fees, and all associated costs.
 
6. Late Fees & Finance Charges
Invoices unpaid for 30 calendar days past the invoice date will incur a late fee of $100.
Beginning on the 1st day of each month following the initial late fee, a finance charge equal to 10% of the remaining outstanding balance will be applied.
Late fees and finance charges continue to accrue until the balance is paid in full.
 
7. Estimate Expiration
All estimates issued by Harkins Equipment LLC carry an expiration date.
If no decision is received from the authorized decision‑maker by the expiration date listed on the estimate, the estimate is considered expired and may require updated pricing or re‑evaluation.
 
8. Storage Policy for Unclaimed or Inactive Equipment
Equipment left in the possession of Harkins Equipment LLC for more than 30 calendar days without communication from the authorized decision‑maker is considered inactive.
If no decision is made by the estimate expiration date, a one‑time storage charge of $100 will be applied for each piece of equipment.
After the initial charge, storage fees of $50 per month per machine will accrue for as long as the equipment remains on‑site without authorized direction.
Storage fees must be paid in full before equipment is released.
 
9. Abandonment
Equipment left for 90 calendar days or more without communication, payment, or authorized direction is considered abandoned.
Harkins Equipment LLC may dispose of, sell, or otherwise liquidate abandoned equipment to recover outstanding charges, including but not limited to estimate fees, storage fees, delivery/pickup fees, repair charges, returned‑check fees, and transaction fees.
Proceeds from liquidation may be applied toward the customer’s outstanding balance. Any remaining balance may still be owed by the customer.
 
10. Customer Responsibility
It is the customer’s responsibility to ensure that the authorized decision‑maker responds promptly to estimates, invoices, and communication requests.
Failure to respond does not exempt the customer from fees associated with storage, diagnostics, or equipment handling.
 
11. Implied Consent & Engagement in Services
By engaging in business with Harkins Equipment LLC—including but not limited to requesting diagnostic services, submitting equipment for evaluation, accepting estimates, or authorizing repairs—the customer acknowledges and agrees that such engagement constitutes implied consent to the terms, policies, and procedures set forth by Harkins Equipment LLC.
This implied consent forms a legally binding agreement between the customer and Harkins Equipment LLC, established through the customer’s voluntary initiation of services and mutual good‑faith intent to conduct business.
Continued communication, submission of equipment, acceptance of estimates, or payment of invoices further affirms the customer’s agreement to all policies contained herein.
 
12. Enforcement of Policy
Harkins Equipment LLC reserves the right to enforce this policy at will.
Failure to comply with any portion of this policy may result in additional fees, withholding of equipment, or legal action as permitted under Ohio law.
 
13. Agreement to Terms
By submitting equipment for diagnostic or estimate services, the customer acknowledges and agrees to the terms outlined in this policy.
